Non-Profit Health Organizations Registration

The Texas Occupations Code (see Laws/Practice Acts) and Board Rules authorize the Texas Medical Board to approve and certify two types of health organizations which meet certain strict criteria. Both types of nonprofit health organizations must keep TMB informed of changes in their by-laws and boards of directors, and must file detailed reports with TMB every two years to maintain their certification. Board Rules concerning nonprofit certification are found in Chapter 177 of the Board Rules.

 

List of 162.001(b) Non-Profit Health Organizations

List of 162.001(c) Non-Profit Charitable Health Centers

 

The first and most prevalent type is referred to in chapter 162.001(b) of the Texas Occupations Code. Characteristics:

  • Is organized as nonprofit corporation.
  • Is organized for a purpose in the public interest, such as research, education or public health,
  • Must be incorporated and directed by physicians licensed by TMB
  • Those physicians must be actively engaged in the practice of medicine.
  • The administrative side of the corporation may be handled by non-physician officers, but all medical decisions and the overall medical policies of the organization must be made by physicians.

The second type of organization is referred to as a 162.001(c) in the Texas Occupations Code. Characteristics:

  • Is organized as nonprofit corporation.
  • Is organized and operated as a migrant, community, or homeless health center in compliance with federal law,
  • May thus employ physicians as an exception to the general rule against corporate practice of medicine.
